The rental market in 2026 looks very different from just a few years ago. Legislative reform, increased tenant awareness and court backlogs mean landlords must approach possession carefully, strategically and lawfully.

At Evictors, we call it the “Possession Playbook” a structured, compliant process that protects your property and income without costly mistakes.

Step 1: Assess the Ground for Possession

Before serving notice, landlords must identify the correct legal route. Most possession claims rely on the Housing Act 1988.

  • Section 21 – Used where the landlord seeks possession at the end of an assured shorthold tenancy (subject to strict compliance requirements).
  • Section 8 – Used where specific statutory grounds apply, such as rent arrears or breach of tenancy.

Errors at this stage can invalidate the entire process.

Step 2: Draft and Serve the Correct Notice

A Section 8 Notice must clearly state the grounds relied upon and provide the correct notice period.

If relying on Section 21, landlords must ensure:

  • The deposit is protected and prescribed information served.
  • Gas safety and EPC certificates were provided.
  • The latest “How to Rent” guide was issued.

Compliance is not optional judges routinely dismiss defective notices.

Step 3: Issue the Court Claim

Where tenants do not vacate, landlords can issue proceedings using Possession Claim Online (PCOL).

Although digital, the system requires precision. Dates, tenancy agreements, deposit details and rent schedules must be accurate. A well-prepared claim avoids adjournments and delays.

Step 4: Enforce the Possession Order

If tenants remain after a possession order, enforcement may require county court bailiffs or transfer to the High Court for enforcement officers. Timing and paperwork are critical to avoid further delay.

Why 2026 Requires a Smarter Strategy

The landscape is evolving. Ongoing reform discussions mean landlords must stay informed and proactive. The days of informal notices and rushed paperwork are over.

Evictors supports landlords through every stage from notice drafting to court representation and enforcement ensuring the process remains lawful, efficient and professionally managed.

Because possession is not just about regaining property. It is about protecting your investment properly.
